General Terms and Conditions – Bike Rental

Article 1 – Definitions
In these general terms and conditions, the following terms are understood:
Lessor: Willemstraatbike B.V., located in Utrecht.
Lessee: the natural or legal person who enters into a rental agreement with the Lessor.
Rental Agreement: the agreement whereby the Lessor makes a bicycle available to the Lessee for payment.
Bicycle(s): all objects rented by the Lessor, including city bikes, e-bikes, cargo bikes, tandems, children's bikes, and accessories.
Rental Period: the period between collection and return of the bicycle(s).

Article 3 – Applicability
These general terms and conditions apply to all offers, reservations, and rental agreements of Willemstraatbike B.V.
By entering into a rental agreement, the Lessee declares to agree to these general terms and conditions.
Article 4 – Formation of the Agreement
The rental agreement is formed as soon as:
- the reservation is confirmed, and
- full payment is received.
The Lessor reserves the right to refuse a reservation without giving reasons.
Article 5 – Rental Fee and Payment
The rental fee is determined based on the current rates as stated on the website or agreed upon at reservation.
The rental fee must be paid in full in advance.
No refund will be given if the reserved bicycle(s) are not collected.
Cancellation is possible up to 48 hours before the start of the rental period. Transaction costs may be charged.
Article 6 – Identification
The Lessee must show a valid identification document at the start of the rental.
The identification document is used solely for identification and rental security and is processed in accordance with GDPR.
Article 7 – Rental Period and Return
The bicycle(s) must be returned no later than the agreed date and time.
In case of late return, the rental will be extended at the applicable daily rate, plus €20 administrative costs.
Extension is only possible with the Lessor's permission and after payment.
Early return does not entitle the Lessee to a refund.
Article 8 – Use of the Bicycle
The bicycle(s) must:
- be used carefully and according to normal use
- only be used by the Lessee
- always be locked with the provided lock when unattended
- not be used on beaches, sandy paths, or unpaved terrain
- not be used outside the Netherlands without permission
Article 9 – Condition of the Bicycle
The bicycle is considered to be received in good condition, unless the Lessee reports damage at the start.
The Lessee must return the bicycle in the same condition.
Article 10 – Damage, Loss, and Theft
The Lessee is fully liable for damage, loss, or theft of the bicycle(s) and accessories.
Costs are determined based on repair costs or replacement value.
In case of loss or theft, the Lessee is obliged to:
- immediately notify the Lessor
- file a report with the police
- hand over both keys
Lost key costs: €37.50 per key.
Article 11 – Theft Insurance (optional)
If theft insurance is taken out, an excess applies of:
- €230 for a city bike
- €750 for an e-bike
- €500 for a cargo bike
- €2,500 for an electric cargo bike
- €400 for a tandem
- €150 for a trailer
Article 12 – Liability
Use of the bicycle(s) is entirely at the Lessee's own risk.
The Lessor is not liable for:
- injury to the Lessee
- damage to third parties
- consequential damage
- loss of belongings
Unless there is intent or gross negligence on the part of the Lessor.
Article 13 – Breakdowns and Repairs
In case of a breakdown, the Lessee must immediately contact the Lessor.
Repairs may only be carried out with the Lessor's permission.
Article 14 – Fines and Violations
All fines and sanctions during the rental period are entirely at the Lessee's expense.
Article 15 – Business Rental
If the Lessee acts on behalf of an organization, this organization is fully liable for all obligations.
Article 16 – Force Majeure
The Lessor is not liable for damage or delay caused by force majeure.
Article 17 – Personal Data
Personal data is processed in accordance with GDPR.
Article 18 – Non-Compliance
If the Lessee fails to meet their obligations, the Lessor is entitled to terminate the agreement, reclaim the bicycle, and recover costs.
Article 19 – Applicable Law
Dutch law applies to all agreements.
Disputes will be submitted to the competent court in Utrecht.
